Terms of Use
1.Who we are and what these Terms cover
This website and its related services are operated by Pest IT Pty Ltd (ABN 53 108 027 694) of 26 Mologa Rd, Heidelberg West VIC 3081, Australia ("Pest IT", "we", "us").
These Terms apply to everything we offer online, including:
- the website at pestit.com.au and its subdomains;
- the online shop and any purchases you make through it;
- our free tools and calculators (including tools hosted on related Pest IT domains such as resources.pestit.studio);
- The Hub — our free knowledge and training resources;
- resources you download from us or receive from us by email (guides, field kits, templates, checklists, decision cards and similar);
- our content — articles, videos, podcasts, industry updates and social posts; and
- any forms, email lists or communities you join through the site.
By using any of these, you agree to these Terms and to our Privacy Policy. If you are using the site on behalf of a business, you confirm you are authorised to accept these Terms for that business.
2.Shop terms
In short: normal Australian online-shopping terms apply, and nothing here reduces your Australian Consumer Law rights.
Orders. An order is accepted when we email you a confirmation or ship the goods, whichever comes first. We may decline or cancel an order (for example, for pricing errors, stock issues or suspected fraud); if we do, we will refund any amount you have paid for that order.
Pricing and GST. All prices are in Australian dollars (AUD) and include GST where applicable, unless stated otherwise. We may correct genuine pricing or description errors, including after an order is placed — if a correction affects your order, we will contact you before proceeding.
Currency and international orders. We display and charge in AUD. We ship to Australia and New Zealand (see our Shipping Policy). If you pay from outside Australia, your bank or payment provider sets the exchange rate and may charge conversion fees, and you are responsible for any import duties, taxes or levies that apply in your country.
Payment. We accept the payment methods shown at checkout. By paying, you authorise the relevant payment provider to debit your nominated method. Card payments are processed by our payment providers; we do not store full card numbers — see our Privacy Policy.
Shipping, risk and title. Shipping is governed by our Shipping Policy. Ownership of goods passes to you on full payment; risk passes on delivery to your address (or on safe-drop where you have given an authority to leave).
Returns and faults. Our Refund Policy applies, alongside any manufacturer warranty.
Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. If you are a consumer in New Zealand, the New Zealand Consumer Guarantees Act 1993 may also apply to your purchase, and nothing in these Terms excludes rights under it that cannot lawfully be excluded.
Business use. Many of our products are professional pest management equipment and supplies. You are responsible for ensuring that anything you buy is suitable for your intended use and is installed and used in line with the manufacturer's instructions, product labels and the laws that apply where you work.
Restricted products. Some products may only be purchased or used by people who hold a licence, permit or other authorisation under the law of their state, territory or country. By ordering such a product you confirm you hold any required authorisation. We may ask for evidence of authorisation, and we may cancel and refund an order where we reasonably believe supply would be unlawful.
Product information. We take care to keep product descriptions, images and specifications accurate, but manufacturers change products from time to time. Check the current label, manual and safety documentation before use.
3.Free tools and calculators
In short: our tools help you scope and plan — the outputs are estimates and general guidance, not quotes, site-specific advice or compliance determinations.
We provide free tools such as job builders, calculators, decision cards and planners.
- Outputs are estimates. Tool outputs are generated from the information you enter and general assumptions. They are a starting point, not a substitute for your own measurement, inspection and professional judgment.
- Not a quote or advice. An output is not a quote, tender, engineering specification, or legal, safety or regulatory advice, and it does not confirm that any product, method or job is compliant with the laws or standards that apply to you.
- Verify before relying. Always verify quantities, measurements, product suitability and current regulatory requirements for your site and your state or territory before acting on an output.
- Using outputs in your business. You may use tool outputs in your own business, including in quotes and documents you prepare for your own clients. You remain responsible for anything you present to your clients.
- Availability. Tools are provided free of charge and may be changed, suspended or withdrawn at any time. Where a tool saves your inputs or sessions, we do not guarantee saved data will be retained.
4.The Hub — knowledge and training
In short: The Hub is free industry education. It's general information for professionals, not formal qualification, licensing or advice.
- Hub content is general industry information and education for pest management professionals and interested readers. It is not legal, work health and safety, medical, veterinary or regulatory advice (see section 8).
- Any progress records, completion records or certificates issued through The Hub are records of participation only. They are not formal qualifications, licences or accreditations unless we expressly state otherwise for a specific course.
- We may update, replace or retire Hub content at any time. Industry rules, product labels and permits change — always check the current requirements that apply to you before acting.
- If The Hub offers accounts or progress tracking, section 6 (Accounts) and our Privacy Policy apply.
5.Intellectual property — what's ours, and what you can do with it
In short: we put real work into what we build and share. Use it, print it, use it in your own business — but don't sell it, strip our name off it, copy it into a competing product, or reverse engineer our tools.
Ownership. All content and materials we create or provide — including website content, articles, images, videos, podcasts, tools, software, calculators, guides, field kits, templates, checklists, decision cards, course materials and downloads — are owned by Pest IT Pty Ltd or our licensors and are protected by copyright and other intellectual property laws. "Pest IT", "AvePro" and other product and program names and logos on the site are brands of Pest IT Pty Ltd or its licensors.
Your licence. We grant you a limited, non-exclusive, non-transferable licence to:
- view and use the website, tools and Hub content;
- download, save and print resources we make available for download or send you by email;
- use those resources in the course of your own business, including in materials and jobs for your own clients;
- adapt resources supplied in editable formats (for example, editable documents, spreadsheets and checklists) for use in your own business, where the resource is clearly designed to be customised; and
- share links to our pages and share unmodified copies of our free resources with colleagues and clients, with Pest IT branding and attribution intact.
Adaptations, outputs and paid content. You own the documents and jobs you create for your own business and clients. The underlying Pest IT resources, templates, tools, software and data remain ours — including where they are embedded in your adaptations — and your adaptations of our materials remain subject to these Terms. Where a product, course or resource is sold with its own licence terms, those terms prevail over this section.
What you may not do. Except with our prior written permission, you may not:
- sell, onsell, rent, sublicense or charge for our content, resources, templates or tool outputs, whether original or modified, on their own or bundled into a paid product, course or service;
- remove or alter branding, attribution or notices, or pass our materials off as your own or anyone else's;
- republish or redistribute our content or resources at scale (for example, hosting our downloads on another site, or reproducing substantial portions of Hub content) — link to us instead;
- copy, adapt or use our materials to build a competing product, tool, course or resource library;
- reverse engineer, decompile, disassemble or otherwise attempt to derive the source code, logic, formulas or underlying data of our tools, calculators or software, or systematically extract their outputs;
- scrape, crawl, harvest or bulk-download the site or its content, or use our content or data to train, fine-tune or ground artificial intelligence or machine learning models; or
- use our materials in a way that is misleading, unlawful, or that suggests Pest IT endorses you, your business or your work when it does not.
Fair dealing. Nothing in this section limits any rights you have under the fair dealing provisions of the Copyright Act 1968 (Cth) or other rights that cannot be excluded by agreement.
Requests. If you'd like to use our materials in a way these Terms don't cover — training, publication, association resources, translations — ask us: nettie@pestit.com. We're often happy to help when it's good for the industry.
6.Accounts
If you create an account (for the shop, The Hub or any other service):
- keep your login details secure and don't share your account;
- make sure the details you give us are accurate and kept up to date;
- you are responsible for activity that occurs under your account; and
- we may suspend or close accounts that breach these Terms, are inactive for an extended period, or are being used in a way that risks harm to us, other users or third parties. You can close your account at any time by contacting us.
7.Acceptable use
You must not:
- interfere with or disrupt the site, tools or servers, or introduce malware or harmful code;
- attempt to gain unauthorised access to any part of the site, other users' accounts or our systems;
- use automated means (bots, scrapers, crawlers) to access the site except for standard search-engine indexing;
- impersonate any person or misrepresent your affiliation with anyone;
- submit false or misleading information through our forms or tools; or
- use the site, tools or content for any unlawful purpose, including in connection with unlawful use of pest management products (for example, contrary to a product's registered label or permit conditions).
We may restrict, suspend or block access to the site, tools or The Hub where we reasonably believe these Terms have been breached.
8.No professional advice
This one matters, so it stands on its own.
Content on this site — including Hub content, articles, industry updates, tool outputs, downloads and anything we share by email or social media — is general information for the pest management industry. It is not, and must not be relied on as:
- legal or regulatory advice;
- work health and safety advice;
- medical or veterinary advice; or
- advice about your specific site, job, business or circumstances.
Regulations, standards, product registrations, labels and permits differ between states and territories and change over time. Information that was accurate when we published it may no longer be current. Before acting, check the current requirements that apply to you and, where appropriate, get advice from a qualified professional (for example, a lawyer, WHS consultant, veterinarian or the relevant regulator).
9.Your content and submissions
If you submit content to us — reviews, comments, form responses, questions for our podcast or events, photos, case studies or other material:
- you confirm you own it or have the right to share it, and that it doesn't infringe anyone else's rights or break any law;
- you grant Pest IT a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and publish it in connection with our business (for example, publishing a review, or featuring a question in a podcast episode). If we use your content in marketing beyond the context you submitted it in, we'll seek your OK first;
- you agree we may publish your content with or without attribution and may make reasonable edits (for example, for length or clarity), and you consent to this for the purposes of the moral rights provisions of the Copyright Act 1968 (Cth);
- don't include confidential or sensitive personal information in public submissions; and
- we may moderate, edit for clarity, or remove submitted content at our discretion.
10.Third-party links and content
The site links to and embeds third-party content (for example, videos, manufacturer resources, industry bodies and regulators). We don't control third-party sites and aren't responsible for their content, products or privacy practices. A link is not an endorsement.
If you believe content on our site infringes your copyright or other rights, email nettie@pestit.com with details of the content and the rights concerned, and we will investigate and respond promptly.
11.Privacy
Our Privacy Policy explains what personal information we collect across the website, shop, tools, The Hub and our marketing — and how we use, share and protect it. It forms part of these Terms.
12.Disclaimers and liability
Free services. The website, tools, The Hub, content and downloads are provided free of charge on an "as is" and "as available" basis. To the maximum extent permitted by law, we do not warrant that they will be uninterrupted, error-free or fit for any particular purpose.
Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability for breach of a consumer guarantee can lawfully be limited, it is limited, at our option, to (for goods) replacing or repairing the goods or paying the cost of doing so, and (for services) resupplying the services or paying the cost of resupply.
Other liability. To the maximum extent permitted by law, and subject to the paragraph above, we exclude liability for indirect or consequential loss, loss of profits, loss of data, or loss arising from your reliance on content, tool outputs or resources contrary to section 3 and section 8, however arising.
Your responsibility. You are responsible for how you apply information, tools and products in your own work, including compliance with the laws, labels, permits and standards that apply to you.
Indemnity. If your breach of these Terms, or your unlawful use of the site, tools, content or resources, causes us loss or a claim against us, you indemnify us for the loss, damage and reasonable costs that directly result — to the extent caused by you. This indemnity does not apply to the extent the loss was caused by our own negligence or breach.
13.Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date and applies from posting. If a change is significant, we'll take reasonable steps to draw attention to it. Your continued use of the site after a change takes effect means you accept the updated Terms.
14.General
If any part of these Terms is found to be invalid or unenforceable, the rest remains in effect. A failure by us to enforce any provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign ours as part of a restructure or sale of our business.
We are not liable for delay or failure to perform an obligation (other than an obligation to pay money) caused by events beyond our reasonable control, such as natural disasters, epidemics, strikes, or carrier and utility failures. These Terms, together with the policies they reference, are the entire agreement between you and us about your use of the site and services — but nothing in this paragraph limits your rights under the Australian Consumer Law.
15.Governing law and contact
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
